No landlord can ever anticipate their tenant will fail to pay rent, resulting in the need for eviction. Eviction cannot be performed legally before terminating the tenancy. This requires giving the tenant written notice that unless they undergo certain provisions, such as pay the rent or find a new home, then you will continue with the eviction lawsuit. Nonpayment of Rent
When a tenant does not pay the rent on the designated due date, the rental management company will serve the tenant a notice indicating the rent is due and provide three to five days in which the tenant can pay the full amount. If the tenant does pay the rent, then there is no eviction.
Unconditional Notice
In some cases, a management company will have the opportunity to remove a tenant from a rental property without any exceptions. However, this type of eviction can only be performed if the tenant has seriously violated the rental agreement or is continuing to break the law in the residence.
Fixing a Violation
Residents who have broken the lease agreement may be served with a notice that requires them to fix the violation, or an eviction will occur. The notice typically gives the tenant a certain amount of time to correct the violation, as pertains to the lease agreement.
30 or 60 Day Notices
Tenants must be given a reason for eviction before the process can occur. The reason should be stated on the 30-day or 60-day notice, depending on the individual situation. However, eviction notices can be as little as 20 days or as long as 90 days. This allows time for the tenant to find a new place to live.
